The H-1B lottery has changed three times in the last six years. If your memory of the process comes from 2018 — or from a coworker who went through it in 2021 — much of what you "know" is now out of date. This guide reflects the current beneficiary-centric system that has been in effect since FY2025.

The mechanics matter. Understanding how the lottery actually selects beneficiaries lets you stop chasing the wrong strategies (multi-registration through consultancies, gaming the master's cap, fake job offers) and focus on what really moves the needle: getting registered, registering early, and pairing the lottery with a cap-exempt backup plan.

The four phases of the lottery cycle

The H-1B cap cycle runs annually from March to October. Each step has hard deadlines and there is no path to recover from missing them.

Phase 1: Registration window (March 1–17)

Registered employers submit a $215 electronic registration for each beneficiary they intend to sponsor. The registration is intentionally short — basic biographical data, passport number, education level, and worksite location. No employment evidence is required at this stage.

Phase 2: Beneficiary-centric selection (late March)

USCIS runs the random lottery. Since FY2025, selection is beneficiary-centric, meaning the system selects unique individuals rather than registrations. If five employers register you, your odds are exactly the same as someone with one registration — but you can pick from any of the five if selected.

Phase 3: Petition filing (April 1 – June 30)

If selected, the employer has 90 days to file the full I-129 petition with all supporting evidence. The clock here is strict: a missed deadline is a forfeit.

Phase 4: Adjudication and start date (August – October 1)

USCIS reviews each petition. Premium processing ($2,805) guarantees a 15-business-day decision. Approved beneficiaries can begin H-1B employment on October 1, the first day of the federal fiscal year.

How the two-pool draw actually works

The lottery has two interconnected pools.

The advanced-degree (master's) pool

If you hold a US master's degree or higher from an accredited institution, you enter the advanced-degree pool first. USCIS selects beneficiaries from this pool to meet the 20,000 advanced-degree allocation.

The regular pool

All registrations — including unselected master's-pool candidates — then compete for the 65,000 regular cap slots. This is why holding a US master's gives you "two chances": you compete in both pools.

The numbers in plain terms

Bachelor's degree: One draw, ~25-30% odds.
US master's or higher: Two draws, ~40-50% odds.
Foreign master's: Same as bachelor's. The advanced-degree allocation is specifically for US-issued degrees.

Why the FY2025 reform mattered

Before FY2025, lottery selection was per-registration. Consultancies discovered they could register one beneficiary through dozens of shell sponsors, dramatically increasing odds. By FY2024 this had pushed registration volume to nearly 800,000 — for 85,000 slots.

The beneficiary-centric reform broke this loophole. Registration volume dropped to roughly 480,000 in FY2025 and held similar in FY2026. The effect: genuine candidates' odds roughly doubled overnight, and consultancy-pumped numbers collapsed.

Second-round selections

If USCIS doesn't receive enough complete petitions by the June 30 deadline from the first round of selections, they run a second-round lottery in late July or August from the unselected pool. This has happened in 3 of the last 5 fiscal years. Your registration remains valid for the second round automatically — no action needed.

What you can (and can't) do to improve your odds

Things that genuinely help

Earn a US master's — the advanced-degree pool is the single biggest leverage point.
Apply broadly — having an offer with a registered, willing employer is the prerequisite to any odds at all.
Line up a cap-exempt fallback at a university hospital or research institute.

Things that don't help anymore

Multiple registrations through consultancies — the beneficiary-centric reform killed this.
"Guaranteed selection" services — they're selling something that no longer exists.
Registering at multiple employers as backup — same beneficiary, same odds.

If you're not selected

"The first two years I worked at consultancies that registered me through three different sponsor entities each. I thought the math was on my side. After the 2024 reform, I switched to a direct hire and registered with just one employer. My odds actually went up — and I was finally selected. The 'gaming' approach was a story consultancies told themselves; the math never worked the way they claimed."

Takeaway: Multiple registrations no longer help. Register once with a legitimate sponsor and prepare a cap-exempt fallback while you wait.
