EB-2 vs EB-3: Which Green Card Category Should You Choose?

EB-2 and EB-3 are the two main employer-sponsored green card categories that H-1B workers use. They have different educational and experience requirements, different priority date queues, and, critically, different rates of movement through the visa bulletin. Choosing the right category at the PERM stage is one of the highest-leverage decisions you'll make on the green card path.

This guide breaks down the requirements for each, when downgrading from EB-2 to EB-3 makes sense, when upgrading from EB-3 to EB-2 is worth it, and the country-specific calculations that should drive your decision.

EB-2 requirements

To qualify for EB-2 employment-based green card, your role must require EITHER:

  • An advanced degree (master's or higher), OR
  • A bachelor's degree plus 5 years of progressive post-baccalaureate experience.

What "progressive experience" means

The experience must show increasing responsibility, skill, or knowledge. A 5-year stretch at the same title at the same level doesn't qualify. Promotions, expanded responsibilities, lead roles, or movement to senior individual contributor positions all qualify.

EB-2 sub-category: NIW (National Interest Waiver)

EB-2 NIW lets you self-petition (no employer sponsorship needed) if your work is in the national interest. Common qualifiers include researchers, healthcare workers in underserved areas, and infrastructure-critical roles. NIW skips PERM entirely.

EB-3 requirements

EB-3 has three sub-categories:

  • EB-3 (Skilled Worker): Requires at least 2 years of training or experience.
  • EB-3 (Professional): Requires a US bachelor's degree or foreign equivalent.
  • EB-3 (Other Worker): Less than 2 years experience. Very long backlog.

For H-1B workers, EB-3 (Professional) is the relevant track.

Priority date movement: the real decision driver

For workers born in countries other than India, China, Mexico, or the Philippines, both EB-2 and EB-3 are typically "current", meaning no backlog. The choice doesn't matter much.

For India- and China-born applicants, the choice can mean years of difference.

India

As of mid-2026:

  • EB-2 India: Priority date approximately Q1 2014. Meaning roughly 12-13 years of waiting.
  • EB-3 India: Priority date approximately Q4 2013, slightly older than EB-2.

This unusual pattern (EB-3 ahead of EB-2 for India) has been intermittent for several years. When EB-3 is ahead, many India-born EB-2 applicants downgrade to EB-3 to file I-485 sooner. Wait times can drop by 6-18 months.

China

As of mid-2026:

  • EB-2 China: Priority date approximately Q2 2020, 6-year wait.
  • EB-3 China: Priority date approximately Q3 2021, 5-year wait.

For China, EB-3 is typically ahead by 6-18 months.

Other countries

EB-2 and EB-3 are typically current or have minimal backlogs. Choose based on the role's actual requirements.

How "downgrading" works

Downgrading means filing a new I-140 under EB-3 using your existing approved EB-2 I-140 as the basis. Specifically:

  1. Your employer files a new I-140 in EB-3, citing the same PERM but under EB-3 category.
  2. The new I-140 retains your original priority date from the EB-2 PERM filing.
  3. If EB-3 priority date is current for your country of birth, you can file I-485 immediately.

When downgrade makes sense

  • You're India- or China-born.
  • EB-3 is ahead of EB-2 for your country.
  • You want to file I-485 sooner (faster work authorization for spouse via I-485 EAD; ability to use AP travel; portability).

When downgrade doesn't make sense

  • You're already EB-3, no benefit to staying in EB-3.
  • EB-2 is ahead of EB-3 for your country.
  • You're considering EB-1 or NIW. Those would be better moves.

How "upgrading" works

If you started EB-3 and want to move to EB-2, you can, but it requires a new PERM. The role must legitimately require EB-2-level education or experience. Most upgrades happen because:

  • You earned a master's degree (US or foreign equivalent) during your H-1B period.
  • The role expanded in scope and now legitimately requires more experience.
  • You moved to a new employer where the role qualifies as EB-2.

Upgrade adds 8-18 months of new PERM processing. Worth it only if EB-2 is significantly ahead of EB-3 for your country.

Implications for spouse and children

Your spouse's I-485 priority date follows yours. Once you file I-485, your spouse can file simultaneously. Children under 21 also become derivative beneficiaries.

CSPA (Child Status Protection Act)

If your child turns 21 before I-485 approval, they may "age out" and lose derivative status. CSPA calculations can preserve their eligibility by subtracting I-140 processing time from their actual age. For long-backlog countries this is critical. Talk to your immigration attorney early.

The most common mistake

Workers wait too long to file I-485. The day your priority date becomes current, you should be ready to file the same day, or within days. Late filing means losing AP travel and EAD work authorization opportunities, and sometimes losing the slot entirely if the visa bulletin moves backward.

EB-1 as an alternative

EB-1A (Extraordinary Ability) and EB-1B (Outstanding Researcher/Professor) bypass PERM and have no backlog for non-India/China applicants. For India- and China-born applicants, EB-1 backlogs are shorter than EB-2 but still meaningful (typically 5-7 years).

If your career includes published research, awards, press coverage, or industry recognition, EB-1A is worth considering as an alternative to EB-2 PERM.

The downgrade gamble that paid off

Take Priti, India-born with an EB-2 priority date of March 2017. By 2025 her EB-2 wait was an estimated eight more years. Then EB-3 India moved ahead by fourteen months. Her employer filed a downgrade I-140 in EB-3, retaining her March 2017 priority date.

"Six months later EB-3 India was current for my priority date. I filed I-485 the same week. My EAD arrived in four months. My husband filed his I-485 and we both got Advance Parole. We traveled abroad for the first time in eleven years without worrying about visa stamps. The downgrade was the best immigration decision I've made."
