H-1B Cap-Exempt Employers: Who Qualifies and Why It Matters

Cap-exempt H-1B sponsorship is the most under-utilized strategy in the US immigration playbook. It lets you bypass the lottery entirely, and most international students don't even know it exists until their second lottery loss. By then they have spent two years on OPT and are running out of runway.

This guide explains who qualifies as cap-exempt, what "affiliated" means in practice (the part of the rule almost everyone misses), how concurrent cap-subject and cap-exempt employment works, and how to actually find these jobs.

What cap-exempt means

Under INA § 214(g)(5), four categories of employers are exempt from the annual 85,000 H-1B cap:

  • Institutions of higher education (accredited universities and colleges).
  • Non-profit entities related to or affiliated with an institution of higher education.
  • Non-profit research organizations.
  • Governmental research organizations.

Petitions filed by these employers can be submitted any day of the year, with no lottery, no October 1 start date, and no fiscal year cap. Approval typically takes 2–6 months (15 business days with premium processing).

The "related or affiliated" loophole

This is where the leverage lives. A non-profit that is connected to a university by shared ownership, formal affiliation agreements, or operates as part of the university's teaching/research mission is itself cap-exempt.

Examples of affiliated cap-exempt employers

  • University hospitals: Massachusetts General, NYU Langone, UCLA Medical Center, Penn Medicine, Stanford Hospital, Johns Hopkins Hospital.
  • Research institutes affiliated with universities: Broad Institute, Whitehead Institute, Salk Institute, MIT Media Lab affiliated entities.
  • Non-profit teaching hospitals with academic affiliation agreements.
  • K-12 schools contracting with universities to provide teaching practicum programs.
  • Library and museum systems formally affiliated with universities.

What documentation USCIS expects

For affiliated entities, the petition must include evidence of the relationship, typically the formal affiliation agreement, mission statements showing alignment with the university's educational mission, or proof of shared governance. An experienced immigration attorney is critical here; this is the most-litigated area of cap-exempt classification.

Concurrent employment: the sleeper strategy

You can hold a cap-subject job at a startup AND a cap-exempt H-1B at a university hospital simultaneously. Each role is on its own H-1B petition. The cap-exempt petition can be filed any time of year, gives you legal H-1B status, and protects your status even if your cap-subject employer goes through layoffs.

How concurrent H-1Bs work in practice

  • The cap-exempt employer files an independent I-129 petition.
  • You can work for both employers simultaneously once both are approved.
  • If your cap-subject role ends, your cap-exempt status persists. No 60-day grace period required.
  • The cap-exempt status preserves your priority date if you have an approved I-140.

The path for fresh grads

If you are graduating and the lottery has not gone your way, cap-exempt employment is the cleanest path to staying and building career capital in the US.

High-demand cap-exempt roles

  • Research scientist / post-doc at university labs or affiliated institutes.
  • Software engineer / data scientist at university hospitals (epic implementations, clinical informatics, research computing).
  • Clinical research coordinator at academic medical centers.
  • Faculty positions (any rank, including instructor / lecturer / adjunct).
  • Librarian and archivist roles at research universities.

What cap-exempt does not give you

  • Green card priority. Your I-140 priority date depends on EB category and country of birth, not exemption status.
  • Higher wages. Cap-exempt employers (especially universities) often pay below private-sector rates.
  • Permanent exemption, if you move to a cap-subject employer later, you must enter the lottery unless you're transferring an already-approved cap-exempt H-1B to a cap-subject role with a 6-year window still available.
